Privacy Statement and Terms of Use of this Web Site

Our Web site is a general use Web site that has been created for the purpose of collecting and reporting information of activities of United States Dog Agility Association, Inc. (hereinafter referred to as "USDAA"), 300 South Kirby Street, Suite 101, Garland, TX 75042, USA, which is engaged in the business of producing, licensing, and promoting dog sporting events in the public view, including presentation of such events on television and other mass media. In compliance with federal law, we do not request or accept personally identifiable
information directly from children under the age of 13, without verifying and
receiving the consent of their parent or legal guardian. However, through this
site, a parent or legal guardian may provide such information as part of the
purchase of a dog registration or a junior handler/dog team registration, or
by establishing a Web access account (i.e., Subscriber Services account) that
may include or provide access by a child under the age of 13 so that they may
compete in USDAA sanctioned events and monitor their results through the Subscriber
Services area and other sections of our Web site. If you do so, by providing
this personally identifiable information and purchasing one of these services
on our Web site, you agree that you understand how such information can and
may be used (i.e., the identification of the registrant/competitor in competition
and in public media of any type as explained under "How
do you give your consent?"
section below.)
As required under federal law, the parent of a child under 13 has the option
to agree to the collection and use of the child's information without consenting
to the disclosure of that information to third parties; however, if consent is not granted, the child would be ineligible to participate in events or other
activities that would necessitate such disclosure,
such as USDAA -sanctioned events. Further, USDAA will not
disclose more information about the child than is reasonably necessary for
the child to participate in an activity and to promote the results thereof
including, but not limited to, announcement
of awards, telecast of performance or other coverage in the media. Further,
the parent has the
right to revoke their consent to the further collection and/or use of personal
information about the child at any time and may direct USDAA to delete all
personal information under its control. However, this does not extend to inclusion of such information in any media already distributed or contracted to be distributed (e.g., television or other broadcast or publication) that may be beyond its control. Further, deletion of personal information would result in the cancellation of registrations and/or
subscriber
accounts, as such information is necessary for the ongoing use fo such registrations
and accounts.
What are the Terms and Conditions for use of this Web site?
The terms and conditions of use of this Web site are set forth in this "Legal Notices" page and on Web site pages where purchase transactions may be executed. You should read these disclosures and provisions, as your use of this Web site is governed by them, and through use of our Web site, you have certain obligations and responsibilties that can have financial consequences to you.
A vast amount of information is available through this Web site, including information regarding upcoming events, show results, accomplishments of competitors and their dogs, rules and regulations, listings of groups and more. All of the content on this Web site is here for you to use for your personal, noncommercial use only. That is, you may refer to it and print individual pages for your own personal reference. Through use of this Web site, you agree that you will NOT sell, email, print, reproduce copies of pages, link to or sweep data from our pages for inclusion in another Web site, or collect information for sale or for distribution to others for any reason without first obtaining our express written consent. The fees for this service are for the access to more extensive information on events and news items at time of purchase, and you may continue to access that information during periods of operation of our Web site for the term indicated, beginning within seventy-two hours from the date of purchase. You will have access to any additional information that we may make available periodically during the term. Accessibility to the site is twenty-four hours a day, seven days a week, except during periods of maintenance or temporary outages on the internet beyond our control. Fees for Subscriber or Data Service access are are nonproratable and nonrefundable for any reason, and there are no warranties regarding access for specific times of day or for uninterrupted service that will from time to time occur. We will work diligently to resolve any unexpected interruptions to the best of our ability. Through use of this feature of our Web site, you acknowledge and understand that continuous access is not assured, as it is dependent upon a number of factors, including but not limited to the operation of a computer locally for your access, that you must have "cookies" enabled on your local computer, interruptions in internet connections locally and globally beyond our control, and periods of scheduled and unscheduled maintenance that will periodically occur. There are no refunds, prorations of fees or extensions of term for these occurrences of non-access.
What are your responsibilties and obligations for use of credit cards for purchases on our Web site?
When you make a purchase on our Web site using a credit card for registering a dog, purchasing access to our database through the Subscriber Services section of our Web site or purchasing a product or service through the USDAA Store, you acknowledge and agree to accept all the terms and conditions set forth on this Web site, including those specified on the page where you execute the transaction and this "Legal Notices" page.
As a credit card user you are responsible for complying with terms and conditions set forth by your credit card company. These terms and conditions typically stipulate that you must contact a merchant in an effort to resolve possible discrepancies related to your credit card account before contacting the credit card company to contest the charge. This is because when you contest a charge directly with a credit card company, they or their related processing companies must take action on your request, which includes investigation of the charge by contacting the merchant and reporting back to you. For this service, they automatically charge the merchant a nonrefundable fee of $25 or more to cover their administrative costs, regardless of the outcome of the query. These fees are often referred to as a "chargeback" fees, even though the charge may have been found to be legitimate, and it is treated much like a stop payment order charged on checking accounts, except that they assess the fee to a merchant rather than to you, the credit card holder. After you contest a charge with them, they then contact the merchant and inquire of the merchant about the nature of the transaction and what was purchased. Many such queries are the result of credit card holders not "recognizing" a charge on their statement.
Further, when duplicate credit card charges occur, it is generally because a Web site user accidentally double clicks a "Submit" or "Purchase" button or uses the "Back" and/or "Forward" button on the browser to return to the "submission" page. These and other discrepancies are easily resolved by us and other merchants if you contact us, either immediately or after they appear on your statement. Should you have a browser "hang-up" or other cause to suspect that a duplicate charge may have occurred, you agree to contact us as soon as possible to determine whether duplicate charges have in fact occurred. While we periodically review transactions and immediately reverse what appears to be duplicate erroneous charges, there can be no assurance that we will detect a duplicate without you first bringing this charge to our attention. We do not accept responsibility for such charges if you do not contact us within sixty (60) days of the transaction date.
To assist you in recognizing our transactions on your monthly statement and to aid you in contacting us promptly to resolve any discrepancies associated with your transactions with us through our Web site, USDAA lists its name and telephone number on our charges submitted to your credit card company. This information will show on your credit card statement as the transaction description.
Please note that credit cards are a convenience afforded to you by merchants. If you frequently engage in internet purchase transactions, we advise that you consider logging on to your credit card account and periodically review charges for discrepancies, and if any are found, extend the courtesy of immediately reporting any such discrepancies directly to your merchant before contacting your credit card company. This will avoid possible service fees by the credit card company.
When you use your credit card to purchase a dog registration, data access to our Subscriber Services area, or purchase a product or service in the USDAA Store on our Web site, you consent that the charges are authorized by you and that you agree to contact us promptly regarding any possible discrepancies or duplicate charges that may appear on your credit card statement in order to enable us an opportunity to resolve these matters before you contact your credit card company.
We agree to execute a credit to your credit card for any improper charges that might occur through our Web site and you agree that if you fail to provide us the opportunity to resolve any discrepancies before you contact your credit card company that you will reimburse us promptly for any service fees charged to us by the credit card processing company, and that we may exercise all remedies available to us to collect such reimbursement of these fees.
Further, through the use of a credit card to purchase registrations (of dogs or for junior
handlers) or for the opening of an account for purposes of purchasing merchandise
through our online store or for purchasing access to data in our Subscriber Services
area, you are consenting to and/or representing that you have the legal power
of attorney to consent to
our use and disclosure of personally identifiable information
for purposes of executing a credit card transaction submitted by you. We do not store complete credit card information for security reasons. At any time you may revoke your consent for use of submitted information retained by us by notifying us in writing via
certified mail at the above street address.
How are your rights of privacy protected?
United States Dog Agility Association, Inc. (USDAA) is committed to
protecting your privacy. However, you must realize that by participating in
USDAA-sanctioned events, you are in the public eye and all information relative
to your performances, including personally identifiable information can and
will be reported through this Web site and through other private and public
media. You sign an agreement at the time of your enrollment in an event that
you consent to such use, as further explained below in the section captioned,
"How do you give your consent?"
With respect to information we collect about you on our Web site, we use this information to process your orders, respond to information requests, issue and announce awards, and make notifications or correspond with you about your involvement in dog sporting activities. Also, some of the information may be used to provide you a more personalized experience while you are browsing or shopping in our Online Store, and generally create a better experience for our Web site users. Please read on for more details about our Web site privacy policy.
What information do we collect on this Web site and how do we use it?
An account may be required for you to utilize certain services on our Web
site, such as making purchases in our Online Store, accessing the Subscriber
services section or making queries from the USDAA competition database. When
you create an account, we ask for personally identifiable information, that
is, information which tells us specifically who you are. We need to know your
name, mailing address, phone number, email address, credit card number, security
information and expiration date so that we can process and fulfill your purchase
orders and notify you of your order status. We also ask for other non-personally
identifiable information, such as whether you own an USDAA registered dog when
subscribing to our Subscriber Services area so that we make properly link your
dog registration records with your account. We use the information we collect
to customize your experience and to provide services
and features
that
most
likely
meet
your
needs so that
your
use of
our Web site is more functional and more enjoyable. We do not require that
you provide us any more information than is necessary to provide you the services
represented through this Web site or for participation in USDAA-sanctioned
events.
When purchasing data access privileges to our Subscriber Services area, we also ask for demographic information that is collected and combined with other respondents to the survey. We do not include personally identifiable information such as your name, street address, telephone number or email address with this information. This non-personal, compiled demographic information may be sent to prospective sponsors, advertisers and/or the media for business and promotional purposes.
When purchasing data access services, it is necessary for you to accept a "cookie" from
our server so that we can identify you for purposes of granting you authorized
access. You are not required to accept this cookie and may make adjustments
in your browser software to prevent it; however, your access to exclusive areas
of our server will not be possible if we cannot properly identify you through

In addition to creating an account with us, in the future we may ask you for personally identifiable information at other times, including when you sign up for email message groups and newsletters. We may use this information to send you the email newsletters you request, to notify you of changes to our Web site, and/or of new products in our Online Store and of other promotions.
If you send us email, we may collect and store such information. We use the information to reply to your email communication, and may retain this information until our communications related to such matter is complete. We may also use the information we collect to occasionally notify you about important functionality changes to the Web site and new USDAA services.
How does USDAA protect customer information?
When you place orders or access account financial information, we and our third party Web service vendors use a secure server. We use secure socket layer (SSL) software to encrypt all financial information you input before it is sent to us or our financial institution. Further, we do not store any credit card information on our servers. When you input your information, all credit card information is passed on to our financial institution for processing using SSL encryption technology. We do not directly access or store your credit card account number at any time.

What about "cookies?"
A "cookie" is a small data file stored by your browser on your computer's hard drive. Cookies contain a unique identifier which allows us to match your computer with the information we store for you in our database. Our cookies do not contain any personally identifying information, but they do enable us to personalize and enhance your experience with us. Some examples of ways we may use cookies are: to save your account preferences so that you will not have to re-enter them the next time you visit our Web site; to store account names and passwords you create; to store items added to your shopping cart; to store previous inquiries you make on our Web site or to offer personalized services. Will USDAA disclose the information it collects on its Web site to outside parties?
We will not share your personally identifiable information collected on our Web site to any third party, except as disclosed below. If USDAA decides it may be in your best interest for us to put you in touch with a third party, we will obtain your permission first. We respect your privacy.
Some of your personally identifiable information is disclosed to third party service providers, vendors or manufacturers when you order certain products or merchandise from our Online Store, or when you register dogs, subscribe or otherwise register on our Web site, enter events. We utilize third part Web hosting and an secured outside credit card payment processing service. Your personally identifiable information is disclosed so that these third parties can process and fulfill your orders. Therefore, by ordering certain products or merchandise from our Online Store or registering on our Web site, you are indicating your consent to the release of your personally identifiable information to third parties for those purposes.
All information relative to your ownership or handling of a dog in competition, or a junior handler and their dog and entering competition, and any information with respect to your dog, may be released to USDAA licensed groups, event organizers, the media for promotional purposes and others associated with the event. By registering a dog with us, or by registering a "junior handler" with us, you consent to the use and distribution of this information for any related purpose.
USDAA also will disclose personally identifiable information if legally required to do so through, for example, subpoena, search warrant or other legal process. In this instance, disclosure may take place without your consent.
How can you access, edit or delete your personally identifiable information?
You may access, edit or delete some of your personally identifiable information
by updating your USDAA accounts on our Online Store,
or accessing your Subscriber Services account at usdaa.com. However, you must
notify us in writing via certified mail to 300 South Kirby Street, Suite 101,
Garland, TX 75042 to remove personally identifiable information
from our
records
with
regards to your subscription to the Subscriber Services area,
registrations
of dogs or registration of junior handlers. After receipt of such notice, we
will deactivate your subscription and/or registrations and you will no longer
be able to access the Subscriber Services area or compete under
such registration
in any of our events.
What about privacy policies of Web sites linked to the USDAA Web site?
Our Web site contains links to other, third party Web sites. Please note that once you access another Web site, you are subject to the privacy policy of that Web site. We do not represent or guarantee that those Web site policies conform to our own.
How do you give your consent?
By using our Web site and submitting information as described above, you consent to the collection and use of this information by USDAA and our associated service providers. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we may use it, and under what circumstances we may disclose it. Further, by competing in USDAA® sanctioned events, your name

awards and other performance results, which we also use for purposes of reporting
news events, distribution of awards and other forms of public recognition.
As a competitor, you have consented through the general agreement you signed
as part of your entry form to grant to USDAA and its representatives, agents
and assigns, all rights and permission to use or appropriate your and your
dog's name, biography, likeness, photograph, voice, performing persona, or
other indicia of identity for broadcast, telecast, cablecast, transmission
or distribution in any format or media now known or hereafter to become known,
which includes presentation of such information on our Web site. Through the
agreement, all competitors thereby have consented to release USDAA and its
representatives, agents and assigns from any claim or cause of action for invasion
of their right privacy, right of publicity, right of personality, or any similar
right in connection with that event.
